Countertops.com – Terms & Conditions

1. Acceptance of Terms

By accessing or using Countertops.com, you agree to follow these Terms & Conditions, our Privacy Policy, and all applicable laws. If you do not agree, please do not use our Platform.

2. Eligibility

You must be at least 13 years old (or the minimum age in your country) to create an account. By registering, you confirm that you have the legal right to enter into these Terms.

3. Your Account

• You are responsible for your account, username, and password.
• Keep your credentials secure; you are responsible for all activity under your account.
• Multiple accounts to bypass restrictions or manipulate the Platform are prohibited.
• Countertops.com may suspend or terminate your account at any time without notice for violations of these Terms or at our discretion.

4. User Content & Posting

• You retain ownership of content you post (ads, listings, messages, or other submissions).
• By posting, you grant Countertops.com a non-exclusive, worldwide license to display, distribute, and promote your content on the Platform.
• Countertops.com is not responsible for user-generated content, including errors, omissions, or the legality of any content posted by users.
• Illegal activity is strictly prohibited and will be removed immediately without notice.
• Content flagged by users may be removed. If a post reaches a specific ratio of views to flags, determined by Countertops.com, it will be automatically removed.
• If a user has 5 or more posts within a timeframe we determine that reach this threshold, the account and all posts will be removed from view, and the account flagged for removal.
• We reserve the right to remove content at our discretion for violations of law or these Terms.

5. Prohibited Activities

You may not:

• Harass, threaten, or harm other users.
• Post fraudulent, misleading, or illegal ads.
• Attempt to hack, reverse engineer, or exploit the Platform.
• Use the Platform for unauthorized commercial purposes outside the services offered by Countertops.com.

6. Transactions

• Countertops.com is a connecting platform. We do not sell products or services ourselves.
• Users are solely responsible for transactions, payments, and deliveries.
• We do not guarantee the quality, safety, or legality of items sold through the Platform.

7. Fees & Referrals

• Certain listings or promotions may require payment.
• Referral features allow connecting users. Any commissions or fees will be clearly disclosed.
• Countertops.com is not responsible for disputes between users.

8. Third-Party Links

The Platform may include links to third-party websites. We are not responsible for the content, privacy practices, or policies of these third parties.

9. Intellectual Property

All Countertops.com content (logos, software, design, and technology powered by Professional Remarketing Group, LLC) is our property or licensed to us. You may not copy, modify, or redistribute without permission.

10. Disclaimers

The Platform is provided “as is” and “as available”. We do not guarantee that the Platform is error-free, secure, or always available. Your use is at your own risk.

11. Limitation of Liability

Countertops.com is not liable for lost profits, damages, or disputes between users. Our liability is limited to the maximum extent allowed by law.

12. Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. You agree that any arbitration will take place in the State of New Hampshire, and you waive your right to a jury trial or class action.

13. Termination & Content Removal

• Countertops.com may remove any account or content at any time without notice.
• Illegal activity is strictly prohibited and will be removed immediately without notice.
• Flagged content may be automatically removed if it reaches a threshold determined by Countertops.com.
• If a user has 5 or more posts within a timeframe we set that meet the flagging threshold, the account and all associated posts will be removed and the account flagged for permanent removal.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.

15. Governing Law

These Terms are governed by the laws of the United States, specifically the State of New Hampshire. Any disputes will be resolved in local courts or through arbitration as stated above.

If we find that you are not a good representative of the countertops.com brand in your market than we may notify you of your refund and will discontinue service. You will receive 100% refund if we discontinue service for you in the first 30 days. After the first 30 days we will communicate with you via email if an issue arises. You will need to keep us posted on progress and if the particular issue is not addressed to our satisfaction you will be provided notice of discontinued service. This policy is for all partners and is for the reputation of all our partners.
